The bail agency can be light at the end of the tunnel for a person in jail, this is because some bail amounts are set higher than the amount of cash the court, police station or other agency is able to accept.  This means bail set at higher amounts must have a middleman, between the court and the person posting the bail, this middleman is the bail bondsmen.

 

This is a person who will enter into a contract that is a three party contract, between the agency, the person posting bail and the court.  This contract will be a legal agreement for the amount of bail, requiring that a portion will be put up by the person posting the bail and many times with a higher amount of bail property is used rather than only cash.

 

In some cases is the only bail can be posted by the person posting, higher bail amounts mean that there is a higher percentage of funds which will need to be put down and for some people it's not possible to do so in cash.  This is where the bail agency is able to help because they are allowed by law to accept property such as real estate, vehicles, jewelry, bonds and other real property.  The court is not allowed to accept these types of items when a person is posting bail and they also are not allowed to accept a over a certain amount of cash.  When the amount is over what the court, police station, jail or other agency can accept the only option is to use a bail company or to leave the person remain in jail until they are finished with the court process.

 

Posting bail even in higher amounts has nothing to do with what the court process might be, it does not matter whether that person will be found innocent or guilty, the person posting bail will have the property returned as long as the person appears that all of their court dates.

 

The bail agency will explain these facts to the person posting bail, innocents or guilt does not have factor in the bail amounts that are set, there are certain amounts of bail set for certain types of crimes.  It is up to the person posting bail to decide if having this person released from jail is in their best interests, because loss of your property could be a very real if the person does not appear at all their court dates. This is the only way to post bail for a person who's bail amount has been set at a higher amounts and what the court is allowed to accept, in these cases the only way the bail can be posted is through the third party. This is why these types of agencies are bonded and licensed; this is a way to protect them selves and to protect the person who is posting bail for someone.
